Participant Safety Acknowledgment, Assumption of Risk & Release of Liability

The Annual Nautical Mile Poker Run is a recreational charitable boating event and is not a race. The safety of all participants, volunteers, and the boating public is our highest priority.

By typing my full name below, I acknowledge, understand, and agree that:

• This is a rain or shine event.
• I will use my best judgement when making participation decisions, but there will be no refund if I choose not to participate at any point in time following registration/buy-in.
• I have read and understand the Poker Run rules and agree to follow all event instructions.
• I will comply with all applicable United States Coast Guard (USCG) regulations, Michigan boating laws, and all applicable federal, state, and local laws.
• I understand that this event is a recreational poker run and not a race. I agree that safe boating always takes precedence over speed, competition, or reaching any checkpoint within a particular time.
• I will act responsibly at all times and will not operate a vessel while impaired or otherwise unable to do so safely.
• I am solely responsible for my own actions and decisions and, if I am operating a vessel, for its safe and lawful operation and the safety of all passengers aboard.
• I agree to operate responsibly, maintain safe speeds, obey all no-wake zones and navigation rules, keep a proper lookout, and exercise courtesy and respect toward other boaters, waterfront residents, law enforcement, and event volunteers.
• I understand that participation in this event involves inherent risks, including but not limited to changing weather and water conditions, vessel or equipment failure, collisions, wakes, submerged hazards, slips and falls, personal injury, illness, death, and property damage. I voluntarily assume all such risks associated with participating in this event.
• In consideration for being permitted to participate, I voluntarily release and hold harmless the Nautical Mile Poker Run, its organizers, volunteers, sponsors, donors, host venues, property owners, and their respective officers, directors, employees, agents, and representatives from any and all claims, demands, causes of action, liabilities, damages, losses, costs, or expenses arising out of or relating to my participation in this event, except to the extent such liability cannot be waived under applicable law.
• I agree to follow all directions given by event staff, volunteers, law enforcement officers, emergency personnel, and the United States Coast Guard.
• I grant permission for photographs and video taken during the event to be used by the event organizers for promotional, marketing, or historical purposes without compensation.
• I certify that I am at least eighteen (18) years of age or, if under the age of eighteen, that this agreement has been signed by my parent or legal guardian.

I HAVE CAREFULLY READ THIS AGREEMENT, FULLY UNDERSTAND ITS CONTENTS, UNDERSTAND THAT I AM ASSUMING CERTAIN RISKS AND RELEASING CERTAIN LEGAL RIGHTS, AND I SIGN THIS AGREEMENT FREELY AND VOLUNTARILY.
